When we look into the decision of US Copyright authority, the copyrightability is quite different from othe ip right. For example, even one work which was registeres as design patent will not satisfy the requirements of coyrightability. In this context, we need more research about the copyrightability.

The Work is a single band gold bracelet with a spiral design that twists around the centerback, an inverted laurel leaf closure, and a circular charm engraved with the SNC’s brand name, “Kinsley Armelle.” 

After carefully reviewing the Work overall, the Board finds that it is not sufficiently creative to support registration.  The Work merely consists of a standard cuff style bracelet design with a single symmetrical laurel leaf at the opening, a typical symmetrical spiral ring on the back of the bracelet, and a simple circular charm.  The combination of these elements in this jewelry design is commonplace and expected in jewelry designs,1 and, therefore, does not rise to the level of sufficient creativity for copyright protection.  At best, the Work here amounts to a minor variation of a standard bracelet, but such a trivial variation does not inject a sufficient amount of creativity into the uncopyrightable design, nor does not differ from unprotectable scenes a faire. 

미국 저작권 당국의 결정을 살펴보면 저작권 여부는 지적재산권과는 사뭇 다릅니다. 예를 들어, 디자인 특허로 등록된 저작물 하나라도 공유권 요건을 충족하지 못합니다. 이러한 맥락에서 우리는 저작권법상의 창작성에 대한 더 많은 연구가 필요합니다.

The Work는 센터백을 감싸는 나선형 디자인, 거꾸로 된 월계수 잎 클로저, SNC의 브랜드 이름 "Kinsley Armelle"이 새겨진 원형 참이 있는 싱글 밴드 골드 브레이슬릿입니다.

전체 작업을 주의 깊게 검토한 후 위원회는 등록을 지원하기에 충분히 창의적이지 않다는 것을 발견했습니다. 이 작품은 입구에 대칭적인 단일 월계수 잎이 있는 표준 커프 스타일 팔찌 디자인, 팔찌 뒷면에 있는 전형적인 대칭 나선형 링, 단순한 원형 참으로 구성되어 있습니다. 이 보석 디자인에서 이러한 요소의 조합은 일반적이고 보석 디자인에서 예상되므로1 저작권 보호를 위한 충분한 창의성 수준으로 올라가지 않습니다. 기껏해야 여기 작업은 표준 팔찌의 사소한 변형에 해당하지만 이러한 사소한 변형은 저작권이 없는 디자인에 충분한 창의성을 주입하지 않으며 보호할 수 없는 장면과 다르지 않습니다.
