Today, we would like to talk about NFT, Blockchain, ownership, authentication and its future.

NFT is one of the hottest topics in the world. However, the concept is very elusive and difficult to understand. We are very upset about this situation. Anyhow, we should explore the identity of NFT in order to enter into another world. 

What is the definition of the NFT. We may go to the Wikipedia’s definition, which explain to us the following explanation.

A non-fungible token (NFT) is a unique and non-interchangeable unit of data stored on a digital ledger (blockchain). NFTs can be associated with easily-reproducible items such as photos, videos, audio, and other types of digital files as unique items (analogous to a certificate of authenticity), and use blockchain technology to give the NFT a verified and public proof of ownership. Copies of the original file are not restricted to the owner of the NFT, and can be copied and shared like any file. The lack of interchangeability (fungibility) distinguishes NFTs from blockchain cryptocurrencies, such as Bitcoin.

It is still confusing.

To make it short, it is a kind of authentication system for the digital assets which will be differentiated from the previous assets. In the past, the ownership and authentication depended on the authority of the centralized authority because there was no mechanism to provide its authentication. However, thanks to the blockchain, which ultimately open the new world. It means the the past order will be remodeled and it will accelerate the globalization of the world, which means the previous authority will be passed away.

In this regard, the NFT will have a huge impact on the renovation of the previous the world. However, here, we would like to focus on the practical matters. 

The implication of the NFT will be summarized as follows.

1.Authentication of the digital asset

2. A process of the establishment of the trading of assets in the digital world

3. Change of the paradigm

4. Speed up process toward the digitalization

5. Compromise and balance with the pre-existing order in the physical world.

In this context, the special artworks in the digital world will become important assets which did not use to be traded, but now traded. For example, the resale royalty right was not recognized in the most countries even if some countries recognized it. Now, thanks to the digital world and blockchain, the trace of the ownership has been possible, and it makes it possible to trade the digital assets and request the royalties, etc. However, please keep in mind that in this process, the pre-existing order should be respected, especially for the copyrights, etc. Regardless of these critical points, the NFT will fit the globalization which means the decentralization and a facilitator to the global trade. 

In this stage, we should learn the digital assets, blockchain, and its huge impacts on the pre-existing order of the world. 

The important issues of the trade of the NFT will be summarized as follows.

The NFT will be a major asset which will be freely traded in the circumstanced which the subsequent legal frame will be implemented on a worldwide scale

Keep in mind the guarantee of some safeguards for the perfect rights such as the involvements of the all the related copyright holders, and any possible flaws in terms of ownership, etc., 

The existing second guarantee, if any, for any defect of the NFT

the recognition of the existence of the uncertainty in relation to the NFT

1. Does the alleged owner of the NFT have a legal ownership?

2. Dose the blockchain system have a reliable credibility

3. What or how can I claim if the NFT pose a legal problem?

5. Did I evaluate correctly the value of the NFT in terms of legal and business perspective and others as well

In this regard, at this time, we need to have more positive approach to the NFT which will become more important assets because the online world will be more dominant over the physical world, along with more attention to NFT market and the attitude of learning actively the NFT business sectors.

오늘은 NFT, 블록체인, 소유권, 인증 및 그 미래에 대해 이야기하고자 합니다.

NFT는 세계에서 가장 뜨거운 주제 중 하나입니다. 그러나 이 개념은 매우 이해하기 어렵습니다. 우리는 이 상황에 대해 당황스러운 것이 사실입니다. 어쨌든 다른 세계로 들어가기 위해서는 NFT의 정체성을 탐구해야 합니다.

NFT의 정의는 무엇일까요? 다음장에서 이야기하는 위키피디아의 정의를 참조할 수 있습니다.

NFT(Non-Fungible Token)는 디지털 원장(블록체인)에 저장된 고유하고 교환 불가능한 데이터 단위입니다. NFT는 사진, 비디오, 오디오 및 기타 유형의 디지털 파일과 같이 쉽게 복제할 수 있는 항목과 고유 항목(정품 인증서와 유사)으로 연결될 수 있으며 블록체인 기술을 사용하여 NFT에 검증되고 공개된 소유권 증명을 제공할 수 있습니다. . 원본 파일의 사본은 NFT 소유자에게 제한되지 않으며 다른 파일과 마찬가지로 복사 및 공유할 수 있습니다. 교환 가능성(대체성)의 부족은 NFT를 비트코인과 같은 블록체인 암호화폐와 구별합니다.

한마디로 요약해 봅시다. NFT는 기존 자산과 차별화될 디지털 자산에 대한 일종의 인증 시스템이 도입된 디지털 자산의 일종이라고 해석할 수 있습니다. 과거에는 디지털 자산에 대하여 제대로 된 인증을 제공하는 메커니즘이 없었습니다. 쉽게 말하면 과거에는 오프라인세상에서는 소유권 및 인증이 중앙 집중식 기관의 권한에 의존했습니다.(그런데 디지털자산에서는 이러한 인증제도가 없었습니다.)  그러나 궁극적으로 새로운 세계를 여는 블록체인 덕분에 디지털 자산에 대한 인증이 가능하게 된 것입니다. 이로써 NFT의 출현은 과거 질서를 재편하고 세계화를 가속화한다는 의미를 가집니다. 또한 중앙집권적인 기존 권위가 사라지는 것을 의미합니다.

이와 관련하여 NFT는 이전 세계의 혁신에 큰 영향을 미칩니다. 그러나 여기서는 좀더 실용적인 문제에 초점을 맞추고자 합니다.

NFT의 의미는 다음과 같이 요약될 것입니다.

1.디지털 자산 인증

2. 디지털 세계에서 자산 거래가 확립되는 과정

3. 패러다임의 변화

4. 디지털화를 향한 프로세스 가속화

5. 오프라인 세계의 기존 질서와의 타협과 균형.

이러한 맥락에서 디지털 세계의 특별한 예술 작품은 과거에는 제대로 거래가 활성화되지 않았지만 이제는 거래되는 중요한 자산이 될 것입니다. 예를 들어 재판매 로열티 권리 즉 추급권이라는 권리는 일부 국가에서는 인정하더라도 대부분의 국가에서 인정되지 않았습니다. 이제 디지털 세계와 블록체인 덕분에 소유권의 흔적이 남게 되었고 그 거래상황의 추척이 가능하게 되어, 원작가 등이 이에 따른 로열티 등을 요구할 수 있게 되는 등 이와 같은 형태로 디지털 자산을 거래할 수 있게 되었습니다. 그러나 이 과정에서 이미 존재하는 기존 질서, 특히 저작권 등 부분은 중요하고 나아가 이에 대한 주의는 절대적으로 필요하고 나아가 이들 기존 권위는 존중되어야 합니다. 그럼에도 NFT는 탈중앙화를 의미하는 세계화와 글로블 거래를 촉진할 것입니다. 

이 단계에서 우리는 디지털 자산, 블록체인, 그리고 그것이 기존 세계 질서에 미치는 엄청난 영향등에 대하여 관심을 가지고 또한 열심히 공부해야  합니다.

NFT 거래의 중요한 쟁점을 요약하면 다음과 같습니다.

NFT는 후속 법적 프레임이 전 세계적으로 구현되는 상황에서 자유롭게 거래되는 주요 자산이 될 것입니다.

모든 관련 저작권자의 개입 등 완전한 권리를 위한 일부 보호 장치의 보장과 소유권 측면에서 발생할 수 있는 모든 결함 등을 염두에 두십시오.

4. 가능한 법적 문제를 염두에 두고 NFT를 평가했습니까?

5. 법률 및 비즈니스 관점 및 기타 측면에서 NFT의 가치를 올바르게 평가했습니까?

그런 점에서 현시점에서는 NFT 시장에 대한 관심과 적극적인 학습 태도와 함께 온라인 세상이 물리적 세상보다 점차 더 우세할 것이기 때문에 이 와중에 더 중요한 자산이 될 NFT에 대해 좀 더 긍정적으로 접근할 필요가 있습니다.
